These terms cover the website and general inquiries. Paid consulting, design, and development work is governed by a separate written agreement or statement of work. If those documents conflict with these terms, the written agreement controls for that engagement.

The Site is provided for information about our company, services, and work. Content is for general information only. We may change, pause, or discontinue any part of the Site at any time.

Case studies, testimonials, statistics, and examples describe past work. They are not a guarantee of similar results for your project.

Submitting the contact form or emailing us is a request to start a conversation. It does not create a client relationship, a bid, or an obligation for either party to proceed.

Any estimate, timeline, or approach we share before a signed agreement is indicative only and may change after discovery.

The Site, including text, layout, graphics, logos, and code, is owned by BinaryFunction or our licensors and is protected by applicable intellectual property laws. You may not copy, modify, or redistribute Site materials for commercial use without our written permission.

You retain ownership of materials you send us in an inquiry. By submitting them, you grant us a limited license to use them solely to evaluate and respond to your request.

Ownership of work product created under a paid engagement is defined in that engagement’s agreement, not on this page.

The Site may link to third-party websites (including social profiles and client sites). We are not responsible for their content, policies, or practices.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, BinaryFunction and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site.

Our total liability arising out of your use of the Site will not exceed one hundred U.S. dollars (US $100). This cap does not apply to liability that cannot be limited under applicable law, and it does not limit liability under a separate signed consulting agreement.

You agree to indemnify and hold BinaryFunction harmless from claims arising out of your misuse of the Site or your violation of these terms.

These terms are governed by the laws of the State of CA, United States, without regard to conflict-of-law rules. Courts located in San Francisco, CA will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

We may revise these terms. The “Last updated” date will change when we do. Continued use of the Site after an update means you accept the revised terms.
